1. Eligibility
You must be at least 18 years old, or otherwise able to form a legally binding agreement under applicable law, to use Hooj. By using the Service, you represent and warrant that you satisfy these requirements.
Hooj may restrict access to certain schools, campuses, or communities. We reserve the right to approve, deny, suspend, or terminate accounts at our discretion.
2. Description of the Service
Hooj is a platform that enables users to create listings, communicate with one another, send offers, and complete certain transactions. Hooj is not the buyer or seller of listed items unless explicitly stated otherwise.
Hooj provides a venue for user-to-user interactions. We do not own, inspect, store, verify, certify, or guarantee the quality, safety, legality, authenticity, or accuracy of items listed by users.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You agree to provide accurate, current, and complete information when creating and maintaining your account. You may not impersonate another person, misrepresent your identity, or use Hooj for fraudulent or deceptive purposes.
4. Listings and User Content
You are solely responsible for the content you submit to Hooj, including listings, messages, offers, images, usernames, profile details, and other materials ("User Content").
By submitting User Content, you represent and warrant that:
- You own the item or otherwise have the right to sell or post it.
- Your content is accurate and not misleading.
- Your content does not violate any law, regulation, or third-party rights.
- Your content does not include prohibited items or prohibited conduct.
We reserve the right, but not the obligation, to remove, restrict, edit, or review User Content at any time.
5. Prohibited Conduct
You agree not to use Hooj to:
- Sell, offer, or request prohibited or illegal items.
- Post false, misleading, deceptive, or fraudulent listings.
- Harass, threaten, intimidate, or abuse other users.
- Engage in scams, impersonation, or phishing.
- Infringe intellectual property or privacy rights.
- Circumvent platform safeguards, moderation, or access controls.
- Interfere with or disrupt the security or operation of the Service.
Violation of these rules may result in removal of content, suspension, termination, or other action.
6A. Content Moderation and User Safety
Hooj prohibits objectionable content and abusive behavior, including harassment, threats, hate speech, scams, fraudulent activity, and listings for prohibited or illegal items.
Users can report listings and users through the app, and can block other users to stop further interaction and remove their content from view.
Hooj reviews reports of objectionable content and abusive behavior and may remove content, suspend accounts, or permanently ban users who violate these Terms or our Community Guidelines.
We aim to review and take appropriate action on reported objectionable content within 24 hours.
6. Offers, Messaging, and Transactions
Hooj may provide features that allow users to communicate, negotiate, and send offers. Any agreement formed between users is solely between those users unless Hooj explicitly states otherwise.
Hooj is not responsible for:
- The truth or accuracy of listings or messages.
- The conduct of buyers or sellers.
- The condition, legality, quality, safety, or delivery of items.
- The outcome of negotiations or transactions between users.
Users are solely responsible for evaluating counterparties, arranging meetups safely, verifying items, and deciding whether to complete a transaction.
7. Payments and Hooj Pay
Certain transactions may be processed through Hooj Pay or related payment features. Payment processing services are provided by third-party payment providers, including Stripe, and are subject to those providers' terms and policies.
By using payment features, you agree that:
- Payment processing may be handled by third parties.
- Hooj may facilitate payment-related workflows but does not guarantee transaction outcomes.
- Payouts, holds, delays, reversals, or account restrictions may occur in accordance with third-party rules or legal requirements.
Users are responsible for ensuring that payment methods used ont he platform are authorized and legitimate. Hooj reserves the right to reserve transactions, suspend accounts, or restrict payment functionality in cases of suspected fraud, chargebacks, or abuse of payment systems.
Hooj reserves the right to limit, suspend, or disable payment-related features at any time.
8. Fees
Hooj may charge fees for certain features, transactions, boosts, subscriptions, or payment-related services. Any applicable fees will be disclosed before you are charged.
Unless otherwise stated, fees are non-refundable except where required by law.
9. Safety and Meetups
Hooj may provide guidance regarding public meetups, item verification, and transaction safety. Such guidance is provided for informational purposes only.
You are solely responsible for your decisions regarding in-person exchanges, pickups, deliveries, and communications with other users.
Hooj does not supervise or control in-perso meetings between users and is not responsible for the conduct of users during such interactions.
10. Intellectual Property
The Hooj name, branding, software, design, interfaces, and all related content excluding User Content are owned by Hooj or its licensors and are protected by applicable intellectual property laws.
Subject to these Terms, Hooj grants you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose.
11. Suspension and Termination
We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, posed risk to users, exposed Hooj to legal or operational harm, or engaged in fraudulent, abusive, or prohibited behavior.
You may stop using the Service at any time.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
HOOJ DOES NOT WARRANT OR GUARANTEE THE QUALITY, SAFETY, LEGALITY, AUTHENTICITY, OR DELIVERY OF ITEMS OR THE CONDUCT OF USERS.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOOJ AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE.
Use of the Hooj platform and participation in transactions arranged thruogh the platform is at the user's own risk.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOOJ'S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO HOOJ IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).
14. Indemnification
You agree to defend, indemnify, and hold harmless Hooj and its affiliates, officers, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or related to:
- Your use of the Service.
- Your User Content.
- Your transactions or disputes with other users.
- Your violation of these Terms or applicable law.
15A. User Disputes
Hooj is not responsible for resolving disputes between users.
Users agree to attempt to resolve disputes directly with one another. Hooj may, but is not obligated to, assist in resolving disputes or removing listings that violate platform policies.
15. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.
16. Changes to the Service or Terms
We may modify, suspend, or discontinue any part of the Service at any time.
We may also update these Terms from time to time. If we make material changes, we may provide notice through the Service or by other appropriate means. Your continued use of Hooj after updated Terms become effective constitutes your acceptance of the revised Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict of law principles.
